  5. “Products”: refers to water and beverages of all kinds.
  6. “Order”: refers to the order to purchase water through the “ Aqualine ” platform.
  7. “Laws”: refers to the laws and regulations in force in the Kingdom of Saudi Arabia.
  8. “Terms and Conditions”, “Agreement”: They refer to these Terms in addition to the Privacy Policy and all other policies and terms.
  1. Legal limits to our services
    1. ” Aqualine ” is an electronic platform that acts as an intermediary via the Internet between water service providers and consumers who request water and drinks of all kinds at reasonable prices and deliver it to all regions of the Kingdom of Saudi Arabia.
    2. The user knows and agrees that the role of the ” Aqualine ” platform is limited to linking between the service provider and the consumer, The platform provides the following:
      1. Register a free account on the platform.
      2. technical infrastructure such as a call center, and a control panel for service providers to manage requests, and so on.
      3. Displaying products on the platform.
      4. Various payment methods to suit everyone.
      5. Technical support and communication between the parties.
    3. When the consumer contracts with the service provider through the platform, The parties enter into a direct and legally binding relationship, Our role is limited only to the link between the service provider and the consumer.
    4. User agrees that Aqualine collects and processes transaction fees between the parties.
    5. We may, at our sole discretion, modify or update the existing services of the Platform, without any liability to any user.
  2. Legal capacity

We want to ensure that every user is able to form legally binding contracts on the Internet; Therefore, the User acknowledges that he has the necessary legal capacity to enter into and accept these Terms, And that he has full unrestricted legal powers in accordance with the following:

  1. Legal capacity of a natural person: The user of the ” Aqualine ” platform is required to be 18 years of age or older and have the legal capacity required to conclude contracts, If you are under 18 years of age, You must obtain the consent of a parent or legal guardian, their acceptance of these Terms and their agreement to be responsible for your actions, and any fees associated with your use of the Services.
  2. The legal capacity of the business entity: If you are registering as a service provider, You represent that you have the authority to bind that entity to these Terms, You and the business entity will be subject to all applicable laws relating to Internet trading.
  3. User agrees that if he violates this clause, He bears the consequences of this violation in front of others.
  1. Membership policy
    1. To benefit from the ” Aqualine ” platform, You must validly register an Account as prompted in the registration form and agree to the Terms and Conditions, When you become a member, You agree to:
      1. Provide true, accurate and complete data as required in the registration form on the Platform.
      2. maintain the confidentiality of your account data, And restrict others from using the account.
      3. Take responsibility for the activities that occur under your account.
      4. Inform us immediately if the account has been hacked or stolen or any illegal use of the account on the Platform is detected, This is so that we can take the necessary technical measures to maintain the account.
    2. We reserve the right to cancel accounts that have not been confirmed or that have been inactive for a long time.
    3. Membership in the ” Aqualine ” platform is provided under the licensing system to use the platform, We may therefore withdraw this license and terminate your membership in the following cases:
      1. If you do not comply with the terms, policies, rules and guidelines relating to the Platform.
      2. If we are unable to confirm or verify any information provided by you.
      3. If we determine in our sole discretion that any of your actions may cause us harm.
      4. If at any time we deem it appropriate to suspend any violating account.
  2. purchase policy
    1. Persons who can legally enter into online contracts in accordance with the laws of the Kingdom of Saudi Arabia can purchase products through the ” Aqualine ” platform.
    2. All product data including prices, availability and images are provided and updated directly from the service providers (suppliers and distributors).
    3. Offered products must comply with health and safety standards and are authorized to be traded and sold in the Kingdom of Saudi Arabia. And to ensure that it is free from any causes of damage.
    4. Products must be healthy and usable. The service provider should explain all its features and the validity of its use.
    5. Some products may have limited quantities.
    6. Some errors may occur during the process of providing products or providing detailed price information on the Platform by the service providers, So we are not responsible for any errors that you find while completing the order, The platform will send a notification to the service provider to correct the errors.
    7. The consumer agrees to pay for the products as indicated during the ordering process, along with any shipping costs or other fees that apply to this order.
    8. in some cases, The consumer’s request may not be accepted for the following reasons:
      1. Product not available.
      2. Presenting a stolen credit card or payment fraud.
      3. If there is an error in the pictures, price or product description on the platform.
      4. If there is an error when a product is included in the sale or promotion.
    9. It is the consumer’s responsibility to keep track of the status of your order.
  3. Pricing and tax policy
    1. All product prices displayed on the ” Aqualine ” platform are in the local currency (Saudi Riyal).
    2. Prices are subject to modification and updating by the service provider.
    3. Prices include 15% VAT on purchase orders. Any change in the applicable VAT rate will be automatically reflected in the price of the product.
  4. payment policy
    1. The ” Aqualine ” platform provides payment through electronic payment gateways with credit cards, Mada and bank transfer.
    2. You must ensure that the data you enter during the payment process is correct, accurate and valid.
    3. The user must use his bank cards and ensure the correctness and accuracy of the information he enters before completing the payment. In the event that one of the cards is used by another party, he must have an authorization or permission to use it. And therefore, he disclaims the responsibility of the ” Aqualine ” platform as a result.
    4. We do not store credit card numbers on our systems. Payment details are also protected before being transferred using the latest electronic protection technologies that follow the highest security standards.
    5. We have the right to amend this policy by adding new payment methods in the future or canceling any current method. You will be notified if we apply this.
  5. Shipping policy
    1. Orders are shipped to the address specified by the consumer within 3 business days after confirmation by the seller.
    2. The consumer bears the delivery fee of the order in addition to the price of the products.
    3. Shipping may be delayed for reasons of force majeure or circumstances beyond our control, In this case, we will not bear any responsibilities as a result of the delayed delivery of the order. And you will be notified of the delay situation via email or phone by the seller.
  6. Cancellation and return policy
    1. Aqualine reserves the exclusive right to refuse or cancel any order for water and beverage products listed at an incorrect price or not available, Regardless of order confirmation or payment confirmation. In such cases, If the payment is processed, The amount will be refunded to the consumer using the original payment method.
    2. The consumer can cancel the order unless it is accepted or processed by the service provider.
    3. Aqualine does not offer or sell any products to the consumer, Rather, the products are provided by service providers. They are completely independent in the performance of their work. Therefore, the return and exchange policy for service providers will be applied. The consumer acknowledges and agrees that it may vary from one service provider to another.
  7. Usage licenses
    1. Given your agreement to be bound by these Terms, We hereby grant you a non-exclusive, non-transferable, revocable right and license to
      1. Access and use our Services in accordance with these Terms.
      2. access and use any content, information or related materials that may be available through our Services solely for your personal, non-commercial use; And as provided in these terms.
    2. You may not modify any Content you have printed or downloaded in any way.
    3. You do not have the right to violate copyright laws, or brand, or patent, or advertising, or databases, or any intellectual property rights of, or licensed to us or a third party.

  2. You may not license, or sell, or rent, or transfer, or customize, or distribute, or host, or exploit the Service.
  3. You may not attempt to explore or test the capabilities of the Platform or the network or attempt to breach the security system or levels of protection without being authorized to do so.
  4. you may not modify, or translation, or conditioning, or merge, or make derivative works of any part of the Platform.
  5. You may not access the Platform in order to create similar or competing services or websites.
  6. No part of the platform may be copied. or reproduce it, or distribute it, or republish it, or download it, or display it, or send it, or transmit it in any way or by any means.
  7. You may not remove or damage any proprietary logos or marks on the Platform.

All legal rights, intellectual property rights and trademarks in the ” Aqualine ” platform and all copyrights, trade dress, designs, logos and icons, and other intellectual property, materials, and other rights, including software rights, HTML code, and other codes contained therein, including content, text, fonts, images, software, audio, music, video, and digital materials; documents, data and forms, It is the property of us or our licensors.
    2. All trademarks, service marks and trade names are owned, registered and/or licensed by us. You may not use any of our trademarks, service marks or trade names in any media or advertising without our written permission.
    3. You may not copy, reproduce, distribute or commercially exploit any of our services. This includes our content, Only after express written permission from us.

    1. THE SERVICES AND CONTENT OF THE AQUALINE PLATFORM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
    2. We do not make any other commitments related to our services, or products, or services, or other information obtained by you through the Platform, This includes its reliability, accuracy, quality, availability, timeliness, security, or ability to meet your needs;
    3. We are not responsible for the accuracy or reliability of any information or content transmitted or posted via our Services.
    4. The User agrees that all information provided by him (including the registration) is true, accurate and up-to-date in all respects and that it does not infringe any proprietary rights, promote terrorism and hate, or contain material or information that is offensive to others or pornographic images, And on his personal responsibility.
    5. The user agrees to assume full responsibility for his use of the Aqualine platform.
    6. We will not be held responsible for losses. or direct damages, or indirect, or dependency, or incidentals arising out of, including but not limited to:
      1. Information about products.
      2. any failure, or wrong, or omissions, or malfunctions, or stop operating the platform.
      3. Service interruption due to periodic maintenance, repair of technical problems, or the like.
      4. The user fails to maintain the security, confidentiality and privacy of his account data.
      5. Circumstances beyond will, force majeure or emergency circumstances.
    7. We do not warrant that the ads, their content, or images will be accurate, complete, reliable, or error-free.
    8. We do our best to ensure that the platform is available for use around the clock. However, we do not guarantee that the platform will be completely and safely available at the specified time. The Platform may be unavailable from time to time during repair, maintenance or business development.

    2. The User may not transfer all or part of his rights or obligations under these Terms to any third party without the prior written consent of Aqualine .
  7. applicable system
    1. These Terms shall be governed and construed in accordance with the applicable laws of the Kingdom of Saudi Arabia .
    2. If any of these terms are deemed illegal, void or unenforceable under applicable laws, This condition will be deemed severable from these Terms, It does not affect the validity and enforceability of the remaining provisions.
  8. modifications
    1. We have the right to revise and amend these Terms at our sole discretion at any time and for any reason. These modifications will be effective immediately upon being posted on this page. We will update the effective date.
    2. The user must familiarize themselves with these modifications before continuing to use the ” Aqualine ” platform.
    3. Your continued use of the Aqualine platform after any updates to these Terms and the Privacy Policy, whether by addition, deletion or modification, constitutes your express acceptance of these updates.
    4. We have the right to make any modifications or improvements that we deem necessary to the ” Aqualine ” platform to increase its effectiveness, The user is bound by any instructions provided by the platform to him in this regard.
  9. the language

I wrote these conditions in Arabic and English, The Arabic language will be adopted for the purpose of interpreting and implementing these conditions if the English language conflicts with it.

  1. Full agreement

These Terms (or as amended from time to time) set forth the entire agreement between you and Aqualine , and supersede any prior versions of these Terms. In the event that these terms conflict with any of its previous versions, the current version shall prevail. All rights reserved to Aqualine 2022 .
